Community Standards & Rules

I. Introduction

Hyype Space, LLC (“Hyype Space^SM,” “we” or “us”) is the destination for video challenges where you can be yourself, have fun and “bring it,” celebrating the spirit of skills-based competition without negativity. To maintain a positive, open and supportive environment we have created these Community Standards & Rules (the “Rules”) which establish the code of conduct required to use the Hyype Space^SM App (the “App”). The Rules apply to everything and anything on the App. This includes all content and all forms of communication (like text, images, links, likes, videos, emojis and other creative tools) or behavior on the App.

We work hard to account for the various cultural norms and expectations of our users in enforcing these Rules. We understand that some content may be offensive or culturally inappropriate to some users while not being offensive or inappropriate to other users. Cultural norms and many other factors are considered in establishing and enforcing these Community Standards, but they are not necessarily decisive. Also, we may determine that content that would otherwise be removed as a violation of our Rules is in the public interest and choose not to remove the content. Public Interest may include (without limitation) educational, documentary, scientific, artistic, or satirical content. Content falling into one of the example categories (educational, documentary, scientific, artistic, or satirical content) does not guarantee or otherwise mean that content will not be removed for violation of these Rules.

Our Community Standards & Rules are updated occasionally. It is your responsibility to review these Community Standards & Rules regularly to ensure that you understand the expectations and standards for the App you are choosing to use. We reserve the right to decide, at our sole discretion, what behavior or content violates the letter or spirit of these Rules. Our goal is to apply these Rules fairly and consistently, but nobody's perfect.

II. General Rules

a. Reporting a Violation.

We try our best to proactively enforce our Community Standards & Rules using a combination of technology and human review. We also encourage users to report what they believe violates these Rules. To report a potential violation of the Rules please contact us at hello@hyype.space.

b. Video & Content Quality

Hyype Space^SM is a place for original, high quality videos that centers around challenges. We endeavor to provide a high-quality experience for videos and content on the App. To do so, we reserve the right to reject videos and content that is not, in our sole determination, of high quality

Videos will need to meet a minimum standard of content quality to be on the platform. This means that video submissions need to carry a good level of quality in terms of video production, appealing content, and goes along with the spirit of the challenge. While there may be various factors to gauge content quality, we expect videos to meet a few guidelines: 1) for explainer videos, have clear and concise instructions on the challenge and terms, 2) for submission videos, fulfill the requested actions of the explainer videos, 3) video must contain engaging content throughout the entirety of the video, 4) videos must have enough length to showcase public interest, 5) video capture quality that is good enough to be understood by a common viewer.

For example, if a video submission or other content is confusing, has poor visual quality, or generally does not match the spirit of the challenge, it may be rejected under these Rules. For videos or content rejected on quality grounds, we will endeavor to provide some guidance to allow users to repost or further engage with the App with higher quality content.

c. Age Restriction

The App is intended for people 13 and older who are residing in the United States. We reserve the right to remove or otherwise disable accounts we suspect are under this age.

d. Content Rejection & Removal

We will remove content that we have determined violates these Community Standards & Rules. Hyype Space^SM does not have any obligation to provide advanced notice when we remove content for violation of our Community Standards. We will inform users when content cannot be uploaded or is being removed, but it may or may not be in advance of the denial of posting or the removal of the content.

e. Account Suspension & Termination

Just as we can remove content for violation of these Community Standards & Rules, we can also deny your access to the App, temporarily or permanently, for repeated or severe violation of these Rules or other terms as determined by us in our sole discretion. Removal from the App can be the result of actions occurring offline or on other applications or platforms. In the event we determine there is a specific, credible or otherwise imminent threat, we may report such actions to law enforcement or other applicable and appropriate entities.

III. Content Standards

Digitally created or altered content will be treated the same as non-digitally or non-altered content under these Community Standards. All examples and references to “including” are intended as a partial list, not an exhaustive or otherwise exclusive list or grouping.

a. Sexual Content

We do not permit nudity, sexually explicit activities, pornography, sexual exploitation or sexual solicitation on the App, regardless of age. We also do not permit content that depicts, glorifies, normalizes, encourages or supports non-consensual sexual acts, including, the posting of content that includes non-consensual touching, nudity, rape, sexual assault and other sexual violence.

Nudity and sexually explicit activities and pornography include content that, regardless of the age of the individuals, (1) overtly reveals breasts, genitals, anus, or buttocks, (2) behaviors that mimics, implies, or otherwise displays sex or sexual acts, (3) shows overt sexual arousal or stimulation, (4) contains language, explicit or otherwise that refers to sexual activity or gratification, (5) simulates sexual activity with another person, and (6) that alters or changes content or image of an individual to portray or imply nudity or sexual suggestiveness or engagement in nudity or sexual activity.

Sexual exploitation includes content that includes any act or attempt to abuse a position of vulnerability, power or trust for sexual gain, profit or other purpose.

Sexual solicitation includes content that offers, asks or otherwise requests (1) a sexual partner, (2) sexual communication, (3) creation or sharing of sexual content, (4) sexual services or (5) sexual scamming or manipulation.

b. Profanity, Hate or Discriminatory Speech, Behavior or Ideology

We do not permit profanity, hate speech or other discriminatory language, behavior or ideology on the App.

Profanity includes language, symbols or acts that are obscene, blasphemous or irreverent at the time they are made. While we acknowledge that this is a particularly ambiguous term that may have different meanings for different people, we believe it is important to the community we are developing that a App and the community we are creating are opening and welcoming to users and this means taking a more prudent or aggressive approach to what is profane than what may be considered profane in other circumstances, including other applications and platforms.

We have no tolerance for hate or discrimination. Content includes hate and discriminatory speech or behavior if it includes attacks, threatens, incites violence against, or dehumanizes someone based on their (1) race or ethnicity, (2) religion, (3) political view, (4) union or trade association, (5) sex, gender, sexual orientation, or gender identity, (6) nationality or immigration status, (7) caste, (8) weight, or (9) illness of disability (mental or physical). Hate and discriminatory speech and behavior also includes slurs, derogatory terms or behavior, terms or behaviors designed or intended to be derogatory or disparaging and terms and behavior that are offensive to the person or group to whom they are made.

We do not permit content to include statement about individuals or groups being inferior (in any way) or referring to them as criminal, inhuman, animals or inanimate objects because they belong or identify with the categories listed above. Hyype Space^SM also does not permit content to include the promoting, glorifying, normalization or other justification of discrimination, violence, exclusion or any other form of segregation or injustice.

We also do not permit hateful ideology, which includes ideologies, beliefs or philosophies demonstrating or that include hostility toward people because of their identification with or belonging to a category listed above.

c. Threats, Violence & Harm

We do not permit content (audio, visual or otherwise) that is unnecessarily shocking, graphic, sadistic or gruesome. Also not permitted is content promoting, normalizing, or glorifying violence or suffering. Violence and inciting violence are not permitted, even if it does not rise to the level of a threat to public safety.

The following types of content are considered violent or inciting violence and are not permitted on the App: (1) violent, graphic or explicit death or accident to a person or animal, (2) the remains or people or animals (excluding animals portrayed in a manner regularly considered to be food), (3) open wounds or injuries to humans or animals, (4) fighting (real or otherwise) between humans, animals or both or (5) behavior considered to be cruel to humans or animals. Incitement to violence also includes (1) advocating for, directing, encouraging, endorsing, excusing, enabling, planning someone (yourself, another person or a group of people) to commit violence and (2) examples of or instruction on how to commit violence, plan violence, create or maintain weaponry (in any form and including partial instruction).

We do not approve, endorse, condone or enable violence anywhere (on or off Hyype Space^SM). No one is permitted to use Hyype Space^SM to threaten, plan, promote or incite violence, violent extremist organizations, individuals or acts. When, in our discretion, we determine it is reasonable or appropriate, we will report threats, plans or other actions to relevant legal authorities, the threatened individual or group or both.

We do not allow organization on Hyype Space^SM who we determine to be terrorist organizations, hate groups, criminal organizations or other non-governmental armed groups. If we find such organizations or individuals, we will ban their accounts.

Terrorist organizations are individuals or groups that (1) threaten violence, use violence or commit crimes against individuals or groups (2) in pursuit of the acting organization or individual’s objectives. Hate groups are groups or organizations who plan, organize, engage in or otherwise attack or dehumanize one or more people based on any of the following: (1) race or ethnicity, (2) religion, (3) political view, (4) union or trade association, (5) sex, gender, sexual orientation, or gender identity, (6) nationality or immigration status, (7) caste, (8) weight, or (9) illness of disability (mental or physical). Criminal organizations are those organization that, regardless of structure, scope or location, engage in serious or regular occurrence of crimes.

d. Bullying and Harassment

We believe in and are creating a fun and inclusive community and individuals fully expressing themselves. These goals are incompatible with bullying, shaming, abuse and harassment, none of which are permitted on Hyype Space^SM.

Bullying, shaming, abuse and harassment include content that contains (1) threats or actions creating physical, psychological or other harm and that may be designed to intimidate or obtain power, authority or control, (2) threats or degrading statements intended to mock, humiliate, embarrass, intimidate, or hurt an individual, (3) insults or is disparaging, (4) encouragement of, excuses for, instructions for, recreates, promotes bullying, shaming, abuse or harassment, (5) is blaming victims of bullying, shaming, abuse or harassment for what has occurred to them, (6) stalking (online or physically) or trolling, and (7) asks for, wishes for or otherwise hopes for harm to an individual or group.

Sexual harassment is also prohibited. We define sexual harassment as unwanted or inappropriate sexual behavior directed at another person. Sexual harassment also includes content that disparages another person's sexual activity. Hyype Space^SM does not permit sexual harassment or the glorification, justification, normalization, encouragement, recreation, excuse, or promotion of sexual harassment. Sexual harassment can occur even if the individual did not intend for the action to be sexually harassing.

Threatening includes (1) hacking or doxxing with an intent to harass, blackmail or cause serious emotional distress. Doxxing is defined as collecting and publishing personal data or personally identifiable information for malicious purposes. Threatening also includes content that reveals or threatens to reveal details of an individual's sexual life, sexual preferences, sexual orientation, or sexual history.

e. Illegal Activiies, Fraud, or Deception

Hyype Space^SM is not designed or intended and users shall not be used to violate law. We do not permit the trade, exchange, sale, transfer (even if at no cost), promotion, encouragement, instruction in or use of illegal goods or services or action that would constitute illegal or criminal activity. Illegal or criminal activity is defined as acts punishable by law. While content that normalized, recreates, instructs, endorses, encourage, or otherwise facilitated illegal or criminal behavior may not itself be illegal or criminal behavior, we still do not permit these types of content.

Content on Hyype Space^SM cannot include the use, display, depiction, promotion, instruction or trade of firearms, ammunition, firearm accessories, or explosive weaponry, regardless of whether it is permissible to possess.

Hyype Space^SM does not permit content that contains the depiction, instruction for production, endorsement, use, promotion, normalization, encouragement, excuse, or trade of alcohol, tobacco products (including electronic products), controlled substances or other similar items.

Hyype Space^SM does not permit anyone to exploit our App to take advantage of the trust of other individuals. Taking advantage of others trusts includes, phishing, spear-fishing, spam, Ponzi schemes, multi-level marketing, pyramid schemes, fixed betting, investment schemes with promises of unrealistically high returns, tax-shelters, and abusive transactions.

Content is not permitted to include personally identifiable information of (1) a minor (regardless of whether the minor or a parent, guardian or some combination consent) or (2) another non-minor without that individual's knowledge and voluntary consent. Users should not create, post or share content that violates the confidentiality or privacy of personally identifiable information.

f. Self-Harm or Suicide

We do not allow content that includes self-harm, suicide or other actions or behaviors likely to result in harm to those who are involved. Self-harm includes depicting, promoting, recreating, encouraging, endorsing, providing instruction, normalizing, excusing or glorifying activities that could reasonably be expected to lead to or that commonly result in self-harm. Self-harm includes depicting, promoting, recreating, encouraging, endorsing, providing instruction, normalizing, excusing or glorifying (or treats as honorable, heroic or expected) activities that could reasonably be expected to lead to or that commonly result in suicide. If we believe there is real or present danger or risk of danger, we may report the information we have to emergency service or law enforcement.

If you or someone you know is suffering from suicidal thoughts, seek immediate help from a health professional of the suicide prevention hotline (1-800-273-8255). If you or someone else is in immediate danger, contact emergency services at 911.

g. Minor Safety

We are committed to protecting the safety of minors while they are on or engage with Hyype Space^SM. We report child sexual abuse material (CSAM) and supporting evidence to the National Center for Missing and Exploited Children (NCMEC) as well as to any authorities we determine should be informed, based on our sole discretion and the applicable circumstances.

For purposes of these Rules, we consider a minor to be anyone under the age of 18. To protect minors, we have taken several steps within these Community Standards and in other locations throughout the App. As part of this effort, we currently only permit those who are 13 and older to use the App. As a general rule, minors are prohibited from doing anything a non-minor would be prohibited from doing on or with Hyype Space^SM. We also prohibit activities that result in or perpetuate abuse, harm, endangerment or exploitation of minors on Hyype Space^SM. This prohibited activity includes actual audio or visual materials, animations, digitally created content or otherwise manipulated or created content.

We will take action on any content or accounts involving CSAM or sexual exploitation of a minor. Sexual exploitation of minors includes any abuse of a position of power or trust for sexual purposes (which includes sexual contact, sexual gratification or other similar actions). CSAM is defined as any visual depiction of sexually explicit nudity or conduct of a minor, whether it was created, posted or otherwise added to Hyype Space^SM by any adult, a peer of the minor or by the minor. We consider CSAM to include content that (1) communicates or shares offers to trade or sell (through Hyype Space^SM or otherwise) CSAM, (2) depicts, glorifies, instructs, encourages, excuses or justifies, normalizes, victimizes, recreates, creates gain based on or otherwise promotes pedophilia, child abuse, enslavement or endangerment of a minor or any associated content, (3) that would be prohibited if it included or was about a non-minor (see No Nudity, Sexual Activities, Sexual Exploitation or Sexual Solicitation).

Hyype Space^SM also prohibits non-minors from profiting financially, socially or politically from the exploitation of a minor.

We prohibit grooming and other inappropriate emotional behavior with minors. Grooming includes content and other engagement with minors in which an adult builds an emotional relationship with a minor to gain the minor's trust for the purposes of future or ongoing sexual contact, sexual abuse, trafficking, or other exploitation or abuse. Grooming behavior may include flattery, requests for contact (on or off Hyype Space^SM), requests for personal information, solicitation of CSAM, sexual solicitations or comments or giving gifts. We also prohibit content that encourages, is specifically designed for engaging in, glorifies, enables, excuses, depicts, instructs or profits from grooming behavior. The determination of grooming behavior is based on the circumstances and will be determined by Hyype Space^SM.

Nudity and sexual activity are prohibited on Hyype Space^SM, whether or not it involved a minor. For more details, all of which apply to minors and non-minors, please see No Nudity, Sexual Activities, Sexual Exploitation or Sexual Solicitation, above. We also prohibit the following content in relation to minors or when minors are involved: (1) depicting or implication of minor or non-explicit sexual acts, such as intimate kissing, oral and non-penetrating sex, (2) sexualizing of minors, (3) sexually explicit dancing, (4) depicting a minor undressing or already undressed, and (5) implied or veiled nudity of a minor.

Hyype Space^SM also does not permit content that includes harmful activities for minors, including (1) possession or consumption of substances prohibited for minors (or that are prohibited regardless of age), (2) the misuse of legal substances (such as attention enhancing prescription medication), (3) engagement in activities illegal or inappropriate for minors, (4) minors participating in activities that may threaten their health or safety (physical, psychological or otherwise) or the health or safety of others and (5) child abuse, neglect, disparagement, degradation or endangerment.

h. False & Deceptive Information

We want the App to be a place of Trust and openness. We do not permit accounts or content that involve (1) false statements, (2) false engagement, (3) impersonations, (4) misleading information that could cause harm (regardless of whether harm was intended), (5) operating multiple accounts for purposes of increasing your popularity, visibility or status on the App, or (6) forgeries.

Misleading information is defined as content that is inaccurate or false based on the then known circumstances. Harm, in relation to misleading information, is defined as (1) serious or long-term physical or psychological injury or illness, (2) death, (3) serious or long-term trauma, (4) significant property (real, personal, intellectual or otherwise) damage, or (5) undermining public trust in governmental institutions, civic engagement, elections, or scientific findings and the scientific process. For clarification, myths, minor or inadvertent inaccuracies and reputational harm to an individual or company does not by itself constitute misleading information.

Our commitment to genuineness does not prohibit (1) parodies, (2) commentary that do not otherwise violate these community Standards, or (3) fan-based or brand-oriented accounts.

i. Respect for Intellectual Property Rights

Content is not permitted to violate intellectual property rights. Intellectual property rights are explained in detail in the Terms of Use. We take intellectual property rights seriously and strictly enforce the Terms of Use.
